Welcome to the website of Bon Vivant Garments ("Bon Vivant Garments", "We", or "Us"), https//bonvivantgarments.com (the "Website"). These terms and conditions (the "Terms") apply to orders placed by the customer ("You") in your capacity as a consumer for purposes outside of commercial or professional activities. By using the website and placing an order, you agree to be bound by these terms.

We reserve the right to change these terms at any time and without prior notice. The terms available on the website at the time of your order are the version that applies to your order.

PLACING AN ORDER

To be able to place an order, you must be over 18 years old and have a valid credit card or debit card issued by a bank that is acceptable to us.

Please note that all order are subject to availability and that the inclusion of products on the website at a particular time does not mean that these products will be available at all times.

You can only place your order through the website. Make sure that your provided data is correct and true. We will use the data provided to communicatie with you about our order.

OUR AGREEMENT

When you have placed an order, you will receive an email confirming your order. Please not that this email is only a confirmation and not an acceptance of your order. A contract is established when we send you an email confirming that the products have been sent out. Only the products listed in the confirmation mail sent at the time of dispatch will be included in our contract. If we have already received payment for non-available products, we will refund the applicable amount using the same method that was used to make the payment.

ORDER CANCELLATION

If you are a resident of the EU, you can cancel the agreement for any reason and without giving any reason within 7 days of receipt of the products from Bon Vivant Garments. To exercise this right, you must send us a clear message that you want to revoke the agreement, either in writing to Bon Vivant Garments, Van Harenstraat 48, 9076BX, Sint Annaparochie, Netherlands, or by contacting our customer service via info@bonvivantgarments.com. The returning costs are at the customer's own expense and needs to be returned in brand new condition within 7 days after cancellation of the contract.

We will refund the money you paid for the canceled products using the same payment method, unless you have agreed to an alternative. This does not include delivery costs. We do not cover return shipping costs. The refund will be processed within 14 days of receiving your cancellation request, although we may wait until we receive the returned products or proof of their return.

Please be aware that if you have used the products beyond what is necessary to determine their nature, characteristics, and functionality, you will be responsible for any depreciation in their value. Also, note that the right of withdrawal does not apply to products that cannot be returned for health protection or hygiene reasons. If the protective seal has been broken after delivery, we cannot accept a return of the product.

PRICES

The prices displayed on the website include Value Added Tax (VAT) and are final. Please note that shipping costs are not included in these prices and will be charged separately.

Bon Vivant Garments is not responsible for any currency fluctuations or exchange rates that your bank or credit card company may apply when you pay in your country's currency.

PAYMENT

We accept payments via iDEAL, PayPal, bank transfer, Visa, MasterCard, American Express, and various local payment options. Upon receiving your order, we perform a standard pre-authorization check on your payment card to ensure sufficient funds for the transaction. Please note that products will only be shipped after this pre-authorization check is completed. Your card will be charged once the order is accepted.

DELIVERY

Orders within the EU are shipped from Van Harenstraat 48, Sint Annaparochie, 9076BX (Netherlands). When placing an order, you can select either standard shipping or tracked shipping.

We strive to deliver your products within the listed times, but unexpected events such as postal delays or force majeure may sometimes cause longer delivery times. Shipping may also take longer during periods of high sales volume, such as holidays.

RIGHT OF CANCELLATION

If you live within the EU, you have the right to cancel your agreement for any reason within 7 days of receiving your products.

To exercise this right, you must send us a clear message indicating your intention to cancel the agreement. You can do this in writing to Bon Vivant Garments, Van Harenstraat 48, Sint Annaparochie, Netherlands, by contacting our customer service, or by using the standard form provided by your local consumer rights authority. You must also return the products at your own expense no later than 7 days after notifying us of your cancellation.

Discount or promotional codes may be offered occasionally. Please note that specific terms and conditions apply to these codes. Only one promotional discount code can be applied per order.

Unless otherwise stated, all materials on this website, including but not limited to images, illustrations, designs, icons, photographs, video clips, and written content (collectively referred to as the “Content”), are the intellectual property of Bon Vivant Garments, whether owned, controlled, or licensed. No rights, titles, or interests in the downloaded materials or software are transferred to you as a result of such actions.
